The following terms and conditions apply to all members of the party on whose behalf the booking is made and form part of the contract between Hookafly and the client upon confirmation of the booking. Please make sure these terms are read carefully along with the General Chalk Streams Risk Assessment.
BOOKING Bookings should be made direct to Hookafly by email, in writing or by telephone.
PAYMENT The Confirmation Invoice will contain terms and methods of payments. Check the details & raise any queries immediately.
PRICES We reserve the right to amend our prices at any time before you book. Once you have booked, the price of your trip is fully guaranteed and will not change.
BROCHURE, WEB PAGES & PROMOTIONAL MATERIAL All care is taken when compiling advertising material to ensure the information is correct. However we are unable to accept liability when circumstances beyond our control result in the facilities described being altered or withdrawn.
CANCELLATION BY YOU In the event of cancellation by the client, for whatever reason, the following scale of charges is payable: - Prior to 90 days 50% of total cost. 89-0 days 100% of total cost. Hookafly will without obligation endeavour to resell the booking. In the event of a successful re-sale 50% of the payment will be refunded.
GIFT VOUCHERS These are non-refundable and non-transferable and are valid for a period of 24 months from the date of purchase.
CANCELLATION OF GIFT VOUCHERS The original purchaser may cancel a voucher for a full refund within 14 days of purchase.
CANCELLATION BY Hookafly Hookafly reserves the right to cancel your booking in which case we will offer an alternative booking of equivalent standard or a full refund.
ALTERATIONS TO CONFIRMED BOOKINGS If you decide to change any part of your booking after these have been confirmed by our Confirmation Invoice up to 90 days prior to arrival we will try to assist at an administration charge of £30 per alteration plus any additional costs incurred. Changes or alterations within 90 days of arrival will be treated as a cancellation and cancellation charges will apply.
CURTAILMENTS & LIABILITY Neither Hookafly nor any person assisting it shall be liable for the consequences of delays or restrictions from adverse weather, obstructions, repairs or damage to navigational works, flooding, shortage of water, industrial action, fuel-rationing, shortages of or non-availability of fuel or any other cause and reserve the right to restrict the activity if unusual or hazardous conditions prevail. Neither Hookafly nor any person or company assisting or collaborating with it shall be liable for death, personal injury or illness.
FISHERY RULES Each fishery has its own set of rules decided upon by the fishery owner or manager. Please observe these rules at all times, failure to do so might result in you being asked to leave the fishery without recompense. All rods must be in possession of a valid Environment Agency Fishing License.
GUIDES/INSTRUCTORS Guides work from 9am through to 6pm usually with a break mid-day for lunch. If you require their services outside these hours then this is by negotiation and we would ask that your reward the Guide appropriately in addition to any gratuity that you would normally offer. Our guide price does not include flies, leaders and the statutory Environment Agency rod licence.
GOODS SOLD BY Hookafly Risk in the goods will pass to you on delivery. Ownership of the goods supplied shall remain vested in Hookafly and shall not pass to you until payment in full for all such items has been made. Your contract with Hookafly is governed by English Law and any dispute is to be settled in the English Courts.
JURISDICTION CLAUSE This agreement shall be construed in accordance with the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to deal with any disputes arising between you and us or our suppliers.
HEALTH & SAFETY Chalkstream Risk Assessment. As with any outdoor pursuit there are some specific hazards that are associated with fishing rivers and lakes. Please make sure you and other members of your party are aware of these risks.
General Risk Assessment Please note that this is a general risk assessment highlighting the majority of the potential problems/risks you are most likely to encounter during a day of fly fishing, your instructor/guide will bring to your attention any specific risks associated with the venue you are fishing at the beginning of the day and throughout the day. Clearly it’s impossible to anticipate every single problem or potential risk and some circumstances can be and are totally unforeseen, accidents do happen, take care, move slowly and above all use common sense, much of the responsibility for your own safety lies with you.
Duty of Care/Medical Conditions Remember you must advise your instructor/guide if you have any serious medical condition, physical disability or other such limitations at the beginning of the day. It’s also your responsibility to advise your instructor/guide what he or she should do in the event of an emergency in your case. Don’t be afraid to say if you are finding anything too difficult or physically demanding.
